Table of entrenchments[edit | edit source]

Note 1: See the definition of entrenchment in subsection 4(1).

Note 2: A provision of this Constitution or enactment falling in this item shall be of no effect to the extent they are inconsistent with provisions falling in another entrenchment above or falling in the entrenchment: see items 1 and 2 of the table in subsection 10(3).

Note 3: Unless agreed to by all the members of Urabba Parks, this Constitution, or any law or instrument (or part thereof) falling in an entrenchment may not be altered and Urabba Parks may not authorise or do anything falling in an entrenchment: see subsection 128(1).

This table sets out entrenched matters:

(ii) is exempt from a statement under paragraph 151(4)(a); or

(b) the director who introduces the proposed law for the proposal, or is to make or co-sign the instrument for the proposal, or a person acting on the director’s behalf, makes a statement to the House of the Parliament of which the director is a member:

(i) of the reasons for the proposal; and
(ii) including or referring to a statement of reasonableness made by or on behalf of the Visitatorial Commission in relation to the proposal; and

(c) the statement is so made before the making of the enactment of the proposal, and in the case of a proposal brought before a House:

(i) during the member's second reading speech; or
(ii) after not less than 24 hours’ notice is given of the intention to make the statement but before the third reading of the proposed law; or
(iii) with the leave of the House of which the director is a member, at any time before the third reading of the proposed law;

and before the passing of any amendment to the proposal by a House, or in the case of instrument – its approval by a House

(c) that has agreed to the merger or dissolution by a petition made by all the members by residence, or has held a referendum on which at least a simple majority of the members by residence or higher majority provided under law has voted in favour of the merger or dissolution;

provided that paragraph (b) revenue does not include revenue arising from financial assistance from the Executive Government of Urabba Parks or a jurisdictional division and surplus does not include surplus arising from such revenue

Relevant notes from the Explanatory Memorandum[edit | edit source]

353. This Schedule sets out entrenchments and provides for what may be included in an entrenchment as entrenchable matter. A note is included under the header to this Schedule referencing the fact the term ‘entrenchment’ is defined in subsection 4(1) – the definition of an entrenchment is an item falling in the table in clause 1 of this Schedule. Under subsection 128(1) amendment of laws and approval of acts falling in entrenchments requires approval from the members.

354. This clause includes the table of entrenchments. Under the definition of ‘entrenchment’ in subsection 4(1), each item in this table is an entrenchment.

355. An entrenchment which is a letter is known as an ‘entrenching item’. These entrenching items deal with amendments of the table of entrenchments itself, and other procedures relating to approval of entrenched matters generally, such as the requirement for a referendum in the case of a proposed law for an entrenched matter not passing each House of Parliament, and for certificates of reasonableness. See clause 2 (note 357) for more information on how entrenchments are sorted, and for clarification on when an entrenchment falls in another entrenchment.

356. The table of entrenchments is as follows:

addition item (A) – this entrenching item allows for the addition of an entrenchment, of laws, acts and constituencies to an entrenchment;
matter removal item (B) – this entrenching item allows for the removal of entrenchment and provisions and acts from entrenchments;
constituency removal item (C) – this entrenching item allows for the removal of constituencies from entrenchments;
definition amendment item (D) – this entrenching item allows for the amendment and repeal of definitions in subsection 4(1);
heading repeal item (E) – this entrenching item entrenches parts of legislation containing entrenched matter:
table repeal item (F) – this entrenching item entrenches tables containing entrenched matter;
general approval item (L) – this entrenching item provides that all matters to be put to referendum are to be approved by ordinary represented members, being members entitled to elect members of the House of Ordinaries;
dispute resolution item (M) – this entrenching item protects the members of members other than ordinary represented members should a Bill for an :alteration of this Constitution or entrenched matter passes under subsection 128(4) by providing the proposal be put to a referendum in which they form a constituency;
reasonableness item (V) – this entrenching item provides for the statement of reasonableness for Bills for an alteration of this Constitution or entrenched matter;
core matter (1) – this entrenchment protects the charitable and democratic nature of Urabba Parks by entrenching the core elements of its organisational identity as established under this Constitution, such as the jurisdictional system of internal management and the prohibitions on pursuing non-charitable objects and distributing surplus income to its members;
legal system matter (1.1) – this entrenchment relates primarily to core elements of the legal system of Urabba Parks, but also includes provisions relating to human rights and its membership structure;
constitutional system matter (1.1.1) – this entrenchment is taken to be the ‘kernel’ of the operating system of governance established by this Constitution. It also covers the intentions of the Founder – being Hellenic and Landcare in its character, charitable and democratic in its nature;
core representation matter (1.2) – this entrenchment covers basic elements of the jurisdictional system of internal management;
core judicial matter (1.3) – this entrenchment covers the basic elements of the judicial system;
core independent governance matter (1.4) – this entrenchment covers some basic elements of the independent governance service and the requirement for a certificate of reasonableness;
core divisional matter (1.5) – this entrenchment covers basic elements of jurisdictional divisions;
core regional matter (1.5.1) – this entrenchment deals with the establishment and declaration of new original regions;
core campus government matter (1.6) – this entrenchment covers basic elements of the membership and governance of municipal districts of Urabba Parks;
core service membership matter (1.7) – this entrenchment covers basic characteristics of service membership of Urabba Parks;
core patron membership matter (1.8) – this entrenchment covers basic characteristics of patron membership of Urabba Parks;
dissolution matter (1.9) – this entrenchment covers the winding-up of Urabba Parks as well as the changing of its place of incorporation;
identity matter (1.10) – this entrenchment covers the alteration of the name of Urabba Parks;
representation matter (2) – this entrenchment includes matters relating to Parliament. Acts and laws only fall in this entrenchment or an entrenchment falling under this entrenchment (i.e. an entrenchment starting with ‘2.’) if they are classed as ‘representation matter’ within the meaning of clause 5 of this Schedule;
parliamentary structure matter (2.1) – this entrenchment covers the structure of Parliament and rules applicable to members of its Houses;
ordinary representation matter (2.2) – this entrenchment covers matters pertaining to the House of Ordinaries;
general representation matter (2.3) – this entrenchment covers representation matters not falling in entrenchment 2.1 or 2.2;
judicial matter (3) – this entrenchment includes matters relating to the Court of Directors and other tribunals. Acts and laws only fall in this entrenchment if they are classed as ‘visitational matter’ within the meaning of clause 6 of this Schedule;
independent governance matter (4) – this entrenchment includes matters relating to the independent governance service and bodies falling in item 7.11.e of the table in subsection 112(5) . Acts and laws only fall in this entrenchment or an entrenchment falling under this entrenchment (i.e. an entrenchment starting with ‘4.’) if they are classed as ‘visitational matter’ within the meaning of clause 6 of this Schedule;
inquisitorial matter (4.1) – this entrenchment covers matters pertaining to Inquiries Urabba Parks and Enactorial Commissions of Inquiry;
electoral administration matter (4.2) – this entrenchment covers matters pertaining to Elections Urabba Parks, the Electorate Allocation Council and the Returning Officer of Urabba Parks;
ecclesial matter (4.3) – this entrenchment covers matters pertaining to the Church in Urabba Parks;
divisional matter (5) – this entrenchment includes matters relating to jurisdictional divisions. Acts and laws only fall in this entrenchment or an entrenchment falling under this entrenchment (i.e. an entrenchment starting with ‘5.’) if they are classed as ‘divisional matter’ within the meaning of clause 7 of this Schedule;
regional alteration matter (5.1) – this entrenchment covers alterations to the limits of regions (other than by formation of a new region);
regional separation matter (5.2) – this entrenchment covers separations of regions resulting in the formation of a new region;
regional separation matter (5.3) – this entrenchment covers unions of regions;
campus government matter (6) – this entrenchment includes matters relating to membership and governance of municipal districts. Acts and laws only fall in this entrenchment or an entrenchment falling under this entrenchment (i.e. an entrenchment starting with ‘6.’) if they are classed as ‘divisional matter’ within the meaning of clause 8 of this Schedule;
municipal alteration threshold matter (6.1) – this entrenchment allows for the adjustment of thresholds for the purposes of entrenchment 6.2
municipal alteration matter (6.2) – this entrenchment covers the alteration of the limits or dissolution of municipal districts;
service membership matter (7) – this entrenchment includes matters relating to service membership. Acts and laws only fall in this entrenchment if they are classed as ‘service membership matter’ within the meaning of clause 11 of this Schedule;
patron membership matter (8) – this entrenchment includes matters relating to patron membership. Acts and laws only fall in this entrenchment or an entrenchment falling under this entrenchment (i.e. an entrenchment starting with ‘8.’) if they are classed as ‘patron membership matter’ within the meaning of clause 12 of this Schedule;
higher-ranking patron membership matter (8.1) – this entrenchment allows for the original grant of higher-ranking patron membership;
equal-ranking patron membership matter (8.2) – this entrenchment allows for the original grant of equal-ranking patron membership;
ordinary membership matter (9) – this entrenchment includes matters relating to ordinary membership;
property detachment matter (9.1) – this entrenchment provides that the acquisition of property attached to membership of a member must be done on just terms or with the consent of the member;
titular matter (9.1) – this entrenchment covers the allotment of ordinary membership with rights to succeed to the Management a place under the Management.
