Application of this Chapter

(1)  Nothing in this Chapter, any law, instrument made under this Chapter, or any document made under such a law or instrument, is intended:

(a)  to create in any person any legal right or give rise to any legal cause of action; or

(b)  to affect in any way the operation of any law or instrument other than a law or instrument made by or under this Chapter.

Definition of entity for the purposes of this Chapter

(2)  In this Chapter, an entity includes an entity:

(a)  that is a member of the legislative group of which Urabba Parks is Head; or

(b)  that is a member of the foundation influence group of which Urabba Parks is Head not falling in paragraph (a), but only insofar in any power, function, privilege or immunity in of Urabba Parks or a member falling in that paragraph in respect of the member.

Relevant note from the Explanatory Memorandum

315. Subsection (1) provides that except as provided by this Division, nothing in this Part is intended to create in any person any legal right or give rise to any legal cause of action, or affect the operation of any law. This is because this Part deals with the responsibilities of Urabba Parks and entities related to individual rights, public interest rights, community interest rights and stakeholder rights. Subsection (2) provides that a reference to an ‘entity’ in this Part is a reference to an entity that is a member of the legislative group of which Urabba Parks is Head, or that is a member of the foundation influence group of which Urabba Parks is Head, but only insofar in any power, function, privilege or immunity in of Urabba Parks or a member falling in that paragraph in respect of the member.
