Duration of House of Ordinaries

(1)  Every House of Ordinaries shall continue for 3 years from the first meeting of the House, and no longer, but subject to law may be sooner dissolved by the Manager‑General.

(2)  The Parliament may limit the power of the Manager‑General to dissolve the House of Ordinaries, provided no law shall prevent the Manager‑General from dissolving the House upon presentation of a petition made by two-thirds absolute majority of the members of the House.

Relevant notes from the Explanatory Memorandum

123. Subsection (1), based on the section 28 of the Australian Constitution, provides the House of Ordinaries shall be lawfully determined (expire) at the end of 3 years after it first sits following a general election, but may be dissolved subject to law.

124. Subsection (2) provides that no law shall prevent the dissolution of the House if two-thirds of the members agree to the dissolution.
