Sanction for sitting when disqualified
A person commits an offence if the person:
- (a) is declared incapable under this Division to sit as a member of a House of the Parliament on any day; and
- (b) sits or votes in any parliamentary body, or exercises or claims any privilege or immunity of a member of a parliamentary body on that day.
Sanction: $20
Relevant note from the Explanatory Memorandum
150. This section provides for a nominal pecuniary sanction of $20 for persons who sit as a member of a House of the Parliament if not qualified to do so. The intention of this provision is to encourage persons who hold themselves out to be members of a House to ensure they are not aware of any disqualification from sitting as a member.
