Allowance to members[edit | edit source]

(1)  The Parliament may appropriate monies from the Consolidated Revenue Fund for allowances for the members of the Houses of the Parliament, and subject to this subsection (2), a member shall receive the allowance so appropriated, to be reckoned from the day on which the member takes the seat of the parliamentary membership to which the member is chosen.

(2)  Unless the Parliament provides for an allowance for members of Houses that is also an approved benefit falling in item 1 of the table in subsection 90(3), each member of a House of the Parliament shall serve on an honorary basis.

Relevant note from the Explanatory Memorandum[edit | edit source]

156. Subsection (1), based on the section 48 of the Australian Constitution, makes provision for the allowances of members of Houses of the Parliament. Subsection (2) provides that members serve on an honorary basis unless the benefit is also an approved benefit falling in item 1 of the table in subsection 90(3). In order to be an approved benefit under that item it has to be approved by an independent remuneration authority (see the note on section 90).
